Defiant Jarec Wentworth Pleads Not Guilty, Remains In Federal Custody

Screen Shot 2015-03-27 at 3.50.54 PMI’ve just arrived in Phoenix for the annual adult trade show, The Phoenix Forum (which is technically held in Tempe, but everything looks the same here in Arizona, so…), and here’s a quick update to add onto yesterday’s Jarec Wentworth update.

Jarec Wentworth/Teofil Brank pleaded not guilty to felony extortion in federal court yesterday, which means he’s either stupid enough to take this to trial, or he’s hoping for a plea deal. Or, maybe he really believes he’s not guilty (LOL). We’ll know more soon enough.

Meanwhile, Brank’s request to be released on bail wasn’t granted, but it wasn’t denied either. Instead, the court continued the matter until next week, giving the government time “to produce discovery to defense counsel.” I’m betting it’ll have something to do with the loaded gun Brank and his accomplice brought to the scene of his arrest?

Also of interest from the arraignment yesterday is the fact that Brank refused to sign a document acknowledging that he had been made aware of his constitutional rights. Does he (or his public defender) have a legal maneuver up his sleeve, or is Miss Jarec just being bitchy? He always was a feisty one!

    That’s standard procedure in a pending criminal matter. Plead not guilty, take a look at the prosecution’s evidence, negotiate w/the prosecutor about a potential deal to resolve the matter w/o trial. If the plea negotiation doesn’t work then the defendant typically demands trial. Defendants almost never plead guilty at their arraignment date – even those who plead guilty initially usually withdraw their not guilty plea at a later date and then plead guilty after having made a deal w/the prosecution. It’s all standard.

        This isn’t going to make it to trial. He would be a fool not to take a plea agreement and since the victim is very much afraid of being identified, I have a feeling it’s going to be a cushy plea agreement i.e. an offer he can’t refuse. But on the other hand, I’ve known many a man to be stubborn.

          It won’t be cushy at all. The victim notified the fbi so he wasn’t that afraid to get a third party involved. The loaded gun, amount of $$ involved, and the overwhelming evidence they have on him will come into play. The only one that got any kind of cushy deal was probably the friend that was with him and fully cooperating.

          A felony conviction, jail time, fines and restitution will all be on the table.

            I think that depending on what the judge does – gag orders, and defense cross examine, that there maybe a slight chance he will get reduced charges.

            Given the digital evidence of his actions, he is fighting an uphill battle for not getting the maximum sentence. Usually they offer you a “reduced” charge to plea guilty to avoid the expense of going to trial, after that point the prosecution will now go full maximum sentence.

    Yesterday he didn’t actually enter a not guilty plea. He kept trying to make a statement about the indictment and didn’t answer when asked for his plea. The judge entered a not guilty plea for him.

    He didn’t refuse to sign the rights document; it wasn’t presented in time for him to read and sign it so he acknowledged the oral reading. That happens quite a bit as most defendants just sign the thing without reading it.

    The Trial Setting Conference today was pretty interesting.

      As a crap character witness, Dracula seems to indicate psychosis. Marrying a drug addict, and getting into bar fights, while pretending “everything is fine” seems to indicate a larger problem. Dude needs a timeout to evaluate life choices, but given this tidbit from a source that “knows” him, I doubt teo or jarec is the type that is introspective and smart.

    I grew up with teo/jarec….he used to work for me for years (I am a general contractor) he was one of my best guys too! Until he started doing “underwear modeling in L.A. that’s what he called it anyway….here in Sacramento…he eventually quit and started working full time….after a few years well everybody that knows him found out about his “modeling” what can I say….more power to him….we still kept in contact he would come visit me allot we used to go club’s when he was in town….I always wondered about that Audi R8…when he picked me up the first time in it (last year)it looked like he was doing rather good for himself….teo/jarec is a very good guy….he is very easy going and extremely fun to be around he is always the center of attention and ALWAYS has a smile on his face even if his day is shit he always smile laughs very fun guy he will make your day being around him….jarec like myself were born in eastern Europe (Romania) he come from a large family like 5 brothers 4 sisters to be exact…at the same time I am not surprised he got into trouble….again….call him a girl but teo is a stand-up guy…he NEVER did anybody wrong or cheated anybody…Sure he isn’t perfect…….he has a good heart……ever since his wife left him (she got on drugs) he was heart broken and became more of…a rebel…he did end up getting into bar fights and stuff..nothing serious…everybody loves being around him he has a amazing personality….I know for a fact that two wouldn’t do this to this “victim” if this “victim” didn’t do something real bad I teo…I know teo…two acts like this if someone took advantage of him….but there has been other incidents similar…I hope he makes it though this.

        DRACULA didn’t say that Teo’s ex “started out as a junkie.” He said that “she got on drugs.” Teo was married when he was 18. His marriage ended long before he started porn, and the reasons it ended had nothing to do with him supposedly being “closeted.” He didn’t started doing porn until he was almost 21. He had a girlfriend at the time, and she suggested he do porn to earn some extra money. But his main source of income was from painting jobs he got from time to time. Teo is mainly into women. He’s had several girlfriends since his marriage ended. Teo grew up in the Sacto area, went to high school in TN and returned to Sacto. He had many friends in Sacto, some of them gay, and liked to party with them at the clubs.

      The “victim” didn’t deserve to be extorted or have his life threatened, but he also has a history of using and discarding young men (for some reason, many of those men have worked for Sean Cody). What Teo did was wrong, but there seems to be a specific reason he was pushed to the breaking point. If he were a complete sleaze there’s no way he would remain Sean Cody’s most featured-model of all time.

      He was wise to plead not guilty. At the very least it will endure his victims role in all this will receive closer scrutiny (and people are naive if they automatically assume all victims are perfect angels).

        Last time I checked “using and discarding young men” (if even true), isn’t illegal. And whatever his “victim’s role” in this…I can almost bet you, it’s not going to receive any further scrutiny, nor should it. People go to jail every day for feeling like they were pushed to the breaking point over someone else’s actions. The law expects people in these situations to respond though whatever legal channels exist to do so. I’m wondering how scored a straight guy can feel when a gay man dumps him? I would put my chips on all the scrutiny here being on Jarec’s actions.

I am sure Jarec had already been well compensated and could walk away to find his next client. Bottom line is Jarec was greedy and went for a bigger pay off in an illegal way.

            Meaning, that the victim expected Jarek to put out after being paid, and Jarec retaliated with incriminating photos of the victims privates.

          In the initial affidavit there was a gun found in the car that brought Teo to the meeting at Starbucks. That was enough to allow for the redacting of the victims name. During the trial setting conference the victims name almost came out as the prosecution screwed up on the paperwork. The victim’s personal lawyer was present, addressed the court, and managed to have the name remain redacted. The victim’s attorney is a former U.S. Attorney and former Chief of the Major Frauds Section of the Central District court.

            Nothing in the affidavit even remotely supports the conclusion that the gun found in the car that transported Teo to the Starbucks rendezvous posed a threat to the victim’s life. The victim wasn’t even at the Starbucks, and Teo already knew the victim was not going to be
            there because the victim had told him so.

            Moreover, Teo’s associate Yim who drove Teo to the Starbucks admitted to FBI agents that he (Yim) had brought the gun for Teo’s protection, which is plausible when you read in the affidavit that prior to the rendezvous Teo had expressed to the victim his concerns about the change in venue and the substitution of a “friend” of the victim: “I don’t wanna walk up there and f*ckin’ all of a sudden it’s the Fed or something or some bullsh*t, something happens and I’m f*ucked.” In response, the victim indicated that Teo could bring along a friend, which explains how Yim got involved.

            Teo already knows the name of the victim, as do others, surely including Teo’s associate Etienne Yim, who drove Teo to the Starbucks rendezvous and admitted to FBI agents that he (Yim) brought the gun and knew about the extortion scheme. How could Yim know about the extortion scheme but not know the victim’s name?

            The notion that the victim’s name was redacted to thwart a threat to his life is nonsense. His name was redacted simply to protect him from embarrassing inquires, gossip and publicity about his scandalous sexual liaisons that were at the center of the extortion scheme.

            Misconception possibly on my part. I do know that the prosecutor is filing the paperwork for redaction due to damage to the victim. The Judge was ticked that they had not already done it.

            My personal take on the ending will be that once the defense gets the evidence from discovery (due at the end of next week), she will then try to get her client to take a plea bargain.

            It was the victim’s fear of damage to his reputation that motivated him to part with $500K in the first place. To get the court to order redaction, it would seem that there must be convincing evidence of a reasonable fear of serious damage to the victim’s reputation if his name were made public in connection with this case. It seems that a reasonable fear of serious damage to the victim’s reputation is the only kind of damage to the victim that would be considered.

            The evidence recited in the FBI affidavit is already sufficient to prove the charge stated in the Indictment. That evidence alone is sufficient to result in the maximum prison sentence allowed for the charge– even if Teo were to plead guilty and show remorse. Nothing in discovery could possibly increase the sentence. A guilty plea would spare the government and court the time and expense of trial, and perhaps motivate the government to recommend a lighter sentence, maybe even probation. But to approve that, the judge would have to ignore the statutory sentencing guidelines, which I suppose is within his discretion. What a sad mess for Teo. How could he have been so wrongheaded?

        Here’s what bugs me. Teo is not only gay for pay but also an escort, right? So he and the victim must have had an arrangement where goods are traded / exchanged for services. With that in mind, how can you hurt young men emotionally who entered the “relationship” with the clear intent to receive money and gifts for their company (for them it was just business)? Is it really the john’s fault when he ends the business relationship with one gay for pay escort and moves on to another?

        To me this was just a common but criminal cash crab where a young opportunistic man (who is used to use his looks to get what he wants) saw his chance for getting more out of the business relationship than both parties agreed upon at the beginning.

      Teo tweeted this to the victim: “You lied to me and treated me like Shit. …I only wanted to drive cars and Enjoy your company. I guess findin you boys is out of the picture.” Evidently, the victim got on Teo’s “bad side.”

    GuyN90068… and anyone who wants to know the victim’s name. I looked at the docket for this case and read all the filings. The victim’s name is never mentioned, so I don’t know what you’re talking about with “redaction.” The indictment posted on this site blurred out the victim’s initials (“D.B.”), which is hardly enough to identify him.

    Nothing in the court documents indicates that the gun found a car was loaded or that the car belonged to Brank.

    The FBI affidavit states that agents searched the car and found “a Colt Magnum 357 revolver along with six rounds of Winchester .38 special ammunition.”

    Finding “a … revolver along with six rounds of … ammunition” does not imply that the revolver was loaded. “Along with” does not mean the same as “loaded with.”

    The notion that the gun was loaded is one of many examples of incorrect information about the case coming from Str8UpGayPorn and being gobbled up and regurgitated by other porn bloggers who don’t do their own homework.

    The gun had nothing to do with the arrest and is completely irrelevant to the charge stated in the Indictment, which doesn’t even mention the gun or any other weapon. The gun is also completely irrelevant to the sentencing.

    Another correction to the article.

    The article incorrectly states that “official charges will be filed” on the day of the arraignment, March 26.

    That’s not how it works. The “official charges” are contained in an Indictment which is filed BEFORE arraignment. The defense gets a copy of the Indictment days BEFORE arraignment. That is why at arraignment, the defense often waives reading of the charges, because the defense has already read the Indictment.

    In this case, the Indictment was filed on March 20–six days before the arraignment
