Convicted Pedophile Austin Wolf Begs Judge For “Mercy” Ahead Of Monday Prison Sentencing, Gives Disturbing Details On Crime With Co-Conspirator

With former gay porn star Austin Wolf’s sentencing coming up on Monday in New York, the now convicted and admitted pedophile has submitted a sentencing memorandum to the court in which he and his lawyer unsurprisingly ask the judge for leniency and a prison sentence of just 10 years. As you know, Wolf pleaded guilty last June to one count of enticement of a minor, and the mandatory minimum punishment for this felony is 10 years in prison, while the maximum is life in prison.

The full memorandum is a 31-page document that you can read in full down below, but here are relevant excerpts that show Wolf’s request for the 10 years, background on Wolf’s career in gay porn, and a small amount of information on the crime he committed (some of which is redacted) with his unnamed co-conspirator.

Note that Wolf is obviously referred to in the document by his legal name, Justin Heath Smith, and here’s the opening statement:

Note that while Smith is asking for just the 10 years, the Probation Office has submitted their sentencing recommendation of 14 years (168 months). It’s my understanding that judges often lean toward following the Probation Office recommendation, so it’s reasonable to assume that Smith will be locked up for somewhere between 10 and 14 years, but probably not more than 14 years.

The section below goes deep into Smith’s background as a gay porn star, and while he was objectively a popular and award-winning performer, some might feel that he and his lawyer have obviously embellished his stature in the industry to inspire sympathy from the court (do federal judges care about OnlyFans and gay porn star body positivity??): 

That last line and the mention of someone being “vividly triggered” likely has something to do with the crime itself and what led to Smith being arrested. The redacted words might identify the co-conspirator, the victim, or a third person who turned Smith in. Or, the defense might be arguing that a past traumatic event in Smith’s life was “vividly triggered,” and this provoked him to commit the crime.

In the below section, there are disturbing details about the offense, which appears to have been a single incident that included Smith, the co-conspirator (“CC-1”), and the victim. Identifying information has been redacted by the court:

Again, why the redaction before the mention of someone (or something?) being triggered will remain a mystery. In terms of why the co-conspirator isn’t publicly named, that could be to protect his due process rights, if he’s still awaiting trial.

Finally, here is the letter that Austin Wolf (Justin Smith) wrote to the judge, which details his time at the MDC while begging for mercy:

Austin Wolf/Justin Smith will be sentenced this coming Monday, September 29th. As a reminder, whatever the sentence is (at least 10 years but likely not more than 14), he’ll be given credit for the 15 months he’s already served since his arrest in June of 2024.
