Austin Wolf Sentenced To 19 Years In Prison
Former gay porn star turned convicted felon and child sex predator Austin Wolf was in court with his attorneys for sentencing this morning in New York City, but it’s not yet known how many years he’ll be spending in prison. Wolf, whose legal name is Justin Smith, pleaded guilty to Enticement of a Minor, which carries a 10-year mandatory minimum prison sentence. The sentencing was to be handed down at 11am EST, so keep refreshing this page as we wait for the court clerk to update the docket.
UPDATE 9/29, 7pm EST:
Austin Wolf has been sentenced to 19 years in prison, which is almost exactly what the DOJ had asked for in their sentencing memorandum. The DOJ’s full press release is here, and here’s an excerpt:
United States Attorney for the Southern District of New York, Jay Clayton, announced today that JUSTIN HEATH SMITH, a/k/a “Austin Wolf,” was sentenced to 19 years in prison for enticing a minor to engage in illegal sexual activity and for engaging in a pattern of activity involving prohibited sexual conduct. SMITH’s sentence was imposed by U.S. District Judge Paul A. Engelmayer, who also presided over the guilty plea. In addition to the prison term, SMITH, 44, of New York, New York, was sentenced to 10 years of supervised release and a $40,000 fine.
As you’ll recall, Smith never went to trial after being arrested and charged by complaint in June of 2024 on two counts, possession of child porn and distribution of child porn. Both those charges were eventually dropped earlier this year when Smith took a deal and instead pleaded guilty to Enticement of a Minor. Horrifying details on the crime, in which Smith and an unnamed co-conspirator participated in sex acts with a minor in a New York apartment, were revealed in the DOJ’s sentencing request that outlined all of Smith’s criminal conduct with multiple victims, which Smith did not contest as part of his plea.
In Smith’s sentencing memorandum filed earlier this month, he begged the judge for “mercy” and asked to only be sentenced to 10 years in prison. The prosecution, meanwhile, asked for double that term, telling the court that the convicted pedophile should be sent to prison for 20 years. Finally, the Probation Office submitted their sentencing recommendation of 14 years (168 months). Today, the judge clearly ignored the Probation Office and went with the DOJ’s request, which is surprising.
In the weeks after his arrest last year, gay porn studios swiftly removed all of Smith’s pornography work as Austin Wolf from their sites, but some of his amateur “collabs” with other performers are still online on fan pages.
Wolf launched his gay porn career in 2012, shortly after turning 30 years old. Assuming he serves his full term, he’ll be 63 years old when he’s released from prison in 2044, at which time he may be required to register as a sex offender for the rest of his life.
