[UPDATED] Austin Wolf Pleads Guilty To Enticement Of Minor, Now Faces LIFE IN PRISON
While we’re waiting for the full plea agreement to be made public (keep refreshing for updates below), Str8UpGayPorn can confirm that gay porn star Austin Wolf (legal name Justin Heath Smith) has pleaded guilty this morning in federal court to a new count from the DOJ: Enticement of a Minor.
As you’ll recall, Wolf was charged by complaint last year on two counts, possession of child porn and distribution of child porn, but the enticement charge is a new count just added this morning. I had a feeling there could be a plot twist in this case after reading Wolf’s lawyer’s filing earlier this week, in which the attorney told the judge that this was a “complex case involving a similarly complex plea agreement,” and Wolf pleading guilty to this new crime adds another layer to the case. Enticement of a Minor (Title 18, U.S. Code § 2422(b)) carries a mandatory minimum prison sentence of 10 years, and it has a maximum sentence of life in prison. As noted above, Wolf has pleaded guilty to this count.
Earlier this year, Str8Up obtained a transcript from Wolf’s very first court hearing following his arrest, and in it, Assistant U.S. Attorney Getzel Berger alleged that Wolf had sex with a 15-year-old several times and planned to rape a 7-year-old boy in Florida with the help of that boy’s father. Some and/or all of those allegations have finally been charged via the enticement count, as you’ll read in the filing below.
Given that Wolf now faces life in prison (and at least a 10 year mandatory minimum) for enticement of a minor, it’s possible that the CSAM possession/distribution counts might’ve been dropped as part of the plea deal. Wolf’s case has now been referred to probation for presentence investigation, so we’re still several months away from his sentencing.
While we’re waiting to see how the previously charged two counts are resolved and the full plea agreement is made public, below you’ll find filings on the new count, the waiver of indictment, and a forfeiture of property filing, in which it’s stated that Wolf has indeed pleaded guilty. UPDATE:
Austin Wolf’s sentencing has been scheduled for September 29th at 11:00 a.m., and that scheduling order is uploaded below with the other documents. Also, as Str8Up presumed earlier today, the child porn charges Wolf had been facing were in fact dropped, in exchange for his guilty plea to enticement of a minor and potentially life in prison.
The New York Post was inside the courtroom this morning, where Austin Wolf spoke to the judge while pleading guilty.
“In late 2023 or early 2024, I induced a 15-year-old to engage in a sex act, I don’t remember through text or [social media], but phones were definitely used. I know what I was doing was wrong,” he admitted.
At this point, Wolf reportedly began to cry, but he continued, “I apologize. I knew it was wrong when I did it. I don’t blame anyone else for my conduct. [Although there] was another person engaging in the conduct, I take full 100 percent responsibility for my actions and I am prepared for the consequences.”
It’s not known who exactly the “other person” was (there was that father of the 7-year-old boy, but this apology appears to be in reference to the 15-year-old), but it’s reasonable to assume that Wolf aided the DOJ in identifying this person, and he’ll be arrested soon, if he hasn’t been already.
