It’s Over: Austin Wolf To Plead GUILTY To Child Porn Charges, Will Be Sentenced To At Least 5 Years In Prison
While we don’t have details as to which charge he’ll be pleading guilty to (or, perhaps he’ll be pleading guilty to both charges he’s facing: Receipt and Distribution of Child Pornography, Possession of Child Pornography), we do know, finally, that Austin Wolf has accepted a plea deal from the government after being arrested and charged by complaint for child porn possession and distribution exactly one year ago this month.
Str8Up has obtained the request that Austin Wolf’s lawyer filed with the judge asking for a change in the plea hearing date, and in it, the lawyer writes, “This is a complex case involving a similarly complex plea agreement. Mr. Smith (a.k.a. Austin Wolf) intends to plead guilty to a mandatory minimum charge with a significant advisory range under the United States Sentencing Guidelines. Despite collaborative efforts between the parties, we have not had adequate time to fully prepare Mr. Smith for the allocution and all required aspects of the plea because this hearing was scheduled yesterday. Proceeding on the current schedule would not permit meaningful preparation, as contemplated under Paragraph 5(B) of the Court’s Rules.”
As you’ll see in the request below, the lawyer asked for the plea hearing to be held this coming Friday (instead of Wednesday), and the judge granted his request. The letter:
As Str8Up has been reporting since June of 2024, Austin Wolf has been held at the notorious MDC detention center in Brooklyn for the past year, with 11 continuances filed while Wolf and the DOJ worked on a plea deal. Wolf was charged by complaint for allegedly possessing and distributing hundreds of child porn videos after being arrested by the FBI in New York.
Earlier this year, Str8Up obtained a transcript from Wolf’s very first court hearing following his arrest, and in it, Assistant U.S. Attorney Getzel Berger alleged that Wolf had sex with a 15-year-old several times and planned to rape a 7-year-old boy in Florida with the help of that boy’s father. It’s not clear how, if at all, those horrifying claims (which were never charged) played into the plea deal, but we should know what exactly Wolf has pleaded guilty to (again, it’ll either be the distribution, the possession, or both) once the hearing has concluded on Friday afternoon.
The mandatory minimum sentence for Wolf’s charges is five years in prison, while the maximum is 30 years.
