NO BAIL: Austin Wolf Deemed Dangerous Flight Risk, Remains Jailed With “Medical Order” While Awaiting Trial On Child Porn Charges
Gay porn star Austin Wolf will be locked up in a New York jail while awaiting trial on child porn charges, a U.S. magistrate judge ruled today following Wolf’s arrest this morning.
Bail was denied for Wolf (legal named Justin Smith) after he was deemed a danger to the public and/or a flight risk, so he’ll remain behind bars at least until a preliminary hearing on July 29th, if not longer. Here’s the bail disposition document filed after his initial court appearance this afternoon:
As Str8UpGayPorn reported earlier today, Justin Smith was arrested and charged with possession and distribution of over 100 child pornography videos. If convicted on both counts, he faces up to 30 years in federal prison. Disturbing details on the charges and how FBI agents built their case against Smith are here in Str8Up’s previous report.
Smith has obtained legal representation, and an attorney appeared on his behalf this afternoon, as noted in the document below:
Smith and his attorney will conceivably file additional motions asking to be released on bond as the case proceeds, so it’s not immediately clear if he’ll stay in jail for the entire duration of his trial, which could take years. As noted above, the first hearing is on July 29th.
Finally, while court records don’t provide any more details than what you can see in the screencap below (click to enlarge), a sealed “medical order” was issued for Smith while he remains in custody. The location of his New York detention has not been disclosed, but he’s likely at a detention center in Brooklyn where federal inmates are held. This story will be updated as more information becomes available.
