[UPDATED] Judge Grants ANOTHER Continuance In Austin Wolf’s Child Porn Case

There’s been yet another delay in the Austin Wolf child porn case, and this is the third time in as many months that the DOJ and Wolf have agreed to a continuance for 30 more days while they look to close the case without a trial and without an indictment. Wolf, as you’ll recall, was charged by complaint back in June for child porn possession and distribution, but there’s been no grand jury indictment, which is required to proceed with the case. In the new filing this week, the AUSA wrote that Wolf “specifically consented to this request” for a continuance, as seen here:

Therefore, the Government requests a 30-day continuance until October 28, 2024,
to continue the foregoing discussions toward resolving this matter. On September 20, 2024, I
personally corresponded with defense counsel, who stated that the defendant consents to an
extension of the preliminary hearing and Speedy Trial Act deadlines to October 28, 2024, and has
specifically consented to this request. This application has been authorized by Assistant United
States Attorney Andrew Dember, Deputy Chief of the Criminal Division

Austin Wolf could of course reject the government’s motion for a continuance, which would force them to either release him from prison or proceed with the indictment, so you have to assume that their case against him is solid. But, as we’ve noted repeatedly, the information that Wolf has on others must be significant, otherwise neither side would see a plea deal as being worth it. There’s no way that Wolf is comfortable being locked up in the heinous MDC, but I do wonder if plea negotiations typically take this long, especially without being formally charged by indictment?

Gay porn star Austin Wolf will be spending yet another month behind bars in Brooklyn’s notoriously inhumane Metropolitan Detention Center while his lawyers and the government continue their discussions about a possible disposition of the child porn case brought against Wolf earlier this summer. Str8Up has obtained the documents requesting and granting the continuance through September 27th, 2024, and they read almost identically to the previous 30-day continuance that was granted last month.

Here’s the AUSA’s request which, like last month, states that Wolf has specifically consented to the continuance:

As noted last month after the first continuance, a disposition would mean that the case would be closed, and there would be no trial. Wolf’s arrest was on June 28th, and the government then had 30 days to file a Grand Jury indictment against him, which would’ve been presented in the July 29th hearing. That first July 29th hearing was continued to August 28th, and now it’s been moved again to September 27th.

When Wolf was arrested on June 28th, he was “charged by complaint,” which is a first step in a federal prosecution. The next step would be the Grand Jury indictment within 30 days, and one would think that the DOJ would’ve already had that ready to go after the arrest. So, Wolf and his lawyers could be negotiating a deal in exchange for Wolf providing the DOJ with evidence against others. Given the fact that Wolf is repeatedly agreeing to continuances that keep him behind bars at MDC without an indictment, the potential plea deal and the information he has must be worthwhile and significant.
